Segundo o \u00f3rg\u00e3o, a afirma\u00e7\u00e3o \u00e9 falsa e generaliza regras da reforma tribut\u00e1ria que n\u00e3o se aplicam \u00e0 maioria das pessoas f\u00edsicas.<\/strong><img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.png?id=1676367&amp;o=node\" \/>A mudan\u00e7a na tributa\u00e7\u00e3o dos alugu\u00e9is est\u00e1 prevista na\u00a0<a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/lcp\/lcp214.htm\" target=\"_blank\" rel=\"noopener\">Lei Complementar (LC) 214\/2025<\/a>, que cria o novo sistema de impostos sobre consumo, o Imposto sobre Bens e Servi\u00e7os (IBS) e a Contribui\u00e7\u00e3o sobre Bens e Servi\u00e7os (CBS), no modelo de Imposto sobre Valor Adicionado (IVA) dual.<\/p>\n<p style=\"text-align: justify;\">Segundo a Receita, a\u00a0<a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/lcp\/lcp227.htm\" target=\"_blank\" rel=\"noopener\">LC 227\/2026<\/a>, sancionada h\u00e1 duas semanas e que conclui a regulamenta\u00e7\u00e3o da reforma tribut\u00e1ria, n\u00e3o trata de cobran\u00e7a imediata de impostos sobre alugu\u00e9is, como chegou a ser divulgado.<\/p>\n<p style=\"text-align: justify;\"><strong>Pelas regras aprovadas, a loca\u00e7\u00e3o por temporada, de contratos de at\u00e9 90 dias, s\u00f3 pode ser equiparada \u00e0 hotelaria quando o locador for contribuinte regular do IBS\/CBS. No caso de pessoas f\u00edsicas, isso s\u00f3 ocorre se dois crit\u00e9rios forem atendidos simultaneamente: possuir mais de tr\u00eas im\u00f3veis alugados e ter receita anual com alugu\u00e9is superior a R$ 240 mil, valor que ser\u00e1 corrigido anualmente pelo \u00cdndice Nacional de Pre\u00e7os ao Consumidor Amplo (IPCA).<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Quem n\u00e3o se enquadrar nesses crit\u00e9rios continuar\u00e1 sujeito apenas ao Imposto de Renda da Pessoa F\u00edsica (IRPF), sem incid\u00eancia dos novos tributos sobre consumo.<\/strong>\u00a0A Receita afirma que a regra foi desenhada justamente para evitar a tributa\u00e7\u00e3o de pequenos propriet\u00e1rios e reduzir o risco de cobran\u00e7a indevida.<\/p>\n<h2 style=\"text-align: justify;\">Transi\u00e7\u00e3o<\/h2>\n<p style=\"text-align: justify;\">Outro ponto destacado \u00e9 que<strong>\u00a0a reforma prev\u00ea um per\u00edodo de transi\u00e7\u00e3o<\/strong>. Embora 2026 marque o in\u00edcio do novo sistema<strong>, a cobran\u00e7a efetiva e plena do IBS e da CBS ser\u00e1 escalonada de 2027 a 2033<\/strong>. Dessa forma, os efeitos financeiros n\u00e3o ser\u00e3o imediatos para todos os contribuintes.<\/p>\n<p style=\"text-align: justify;\">No caso dos alugu\u00e9is residenciais tradicionais, a carga do IBS\/CBS ter\u00e1 redu\u00e7\u00e3o de 70%, resultando em uma al\u00edquota efetiva estimada em 8%, al\u00e9m do IR. J\u00e1 na loca\u00e7\u00e3o por temporada equiparada \u00e0 hospedagem, o benef\u00edcio \u00e9 menor, mas, segundo a Receita, n\u00e3o chega aos percentuais elevados que v\u00eam sendo divulgados.<\/p>\n<p style=\"text-align: justify;\">Para grandes propriet\u00e1rios, aqueles com muitos im\u00f3veis e alta renda, a tributa\u00e7\u00e3o tamb\u00e9m ser\u00e1 amenizada por mecanismos como al\u00edquota reduzida, cobran\u00e7a apenas sobre valores acima de R$ 600 por im\u00f3vel, possibilidade de abatimento de custos com manuten\u00e7\u00e3o e reforma, al\u00e9m de\u00a0<em>cashback<\/em>\u00a0(devolu\u00e7\u00e3o de impostos) para inquilinos de baixa renda.<\/p>\n<h2 style=\"text-align: justify;\">Ajustes<\/h2>\n<p style=\"text-align: justify;\">A Receita ressalta ainda que ajustes posteriores \u00e0 lei original trouxeram mais seguran\u00e7a jur\u00eddica, diminuindo as hip\u00f3teses de enquadramento como contribuinte e tornando as regras mais favor\u00e1veis \u00e0s pessoas f\u00edsicas que alugam im\u00f3veis por temporada.<\/p>\n<p style=\"text-align: justify;\">A LC 227\/2026, esclareceu o Fisco, favoreceu as pessoas f\u00edsicas que alugam im\u00f3veis, diminuindo as hip\u00f3teses em que elas s\u00e3o enquadradas como contribuintes da CBS e do IBS.
